Do First Home Buyers Pay Stamp Duty in Tasmania?

Good news! If you’re a first-home buyer, you can benefit from a full exemption on stamp duty for established homes valued at $750,000 or less. This exemption, valid from 18 February 2024 until 30 June 2026, is a great opportunity to make your first home purchase more affordable. However, it’s important for you to understand the specific criteria that must be met to qualify for this exemption.

Eligibility Criteria

If you want to take advantage of the stamp duty exemption, you’ll need to meet the following requirements:

  1. Natural Person: You must be a natural person, not a company.
  2. Age Requirement: You must be at least 18 years of age.
  3. Residency Status: You need to be an Australian citizen or permanent resident. If you're buying with someone else, at least one of you must meet this criterion.
  4. Previous Home Ownership: Neither you nor your spouse/partner can have previously owned a home in Australia.
  5. Previous Grants or Concessions: You must not have previously received a First Home Owner Grant in any state or territory of Australia or accessed the Duty Concession (46E of the Duties Act 2001) or Duty Exemption (57G of the Duties Act 2001). The same applies if you have a spouse or partner.
  6. Application Process: You’ll need to complete the necessary application form and submit it with all relevant supporting documentation.

Residential Requirement

In addition to meeting the eligibility criteria, you must live in the home as your principal place of residence for a continuous period of six months, starting within 12 months of purchasing the property. The Commissioner has discretion to adjust this requirement in certain cases, but typically, you must establish a genuine connection with the home.

What does this mean for you? Essentially, the home needs to be where you typically eat, sleep, and carry out your daily activities. Leaving personal belongings at a vacant property won’t satisfy this condition. You’ll need to genuinely make the property your primary residence to fully benefit from the duty concession.

What Properties Are Excluded?

It’s important to keep in mind that not all properties qualify for the stamp duty exemption. Here’s what you need to know:

  • New Homes: If you’re purchasing a new home, it won’t qualify for the exemption, and the full stamp duty will apply.
  • Vacant Land: buying vacant land? Unfortunately, it’s excluded from the exemption as well.
  • Established Homes Valued Over $750,000: If the established home you’re purchasing is valued above $750,000, you’ll also be required to pay the full stamp duty.
